INSTITUTIONAL DEVELOPMENT OF THE STATE FOREST STRUCTURES AFTER THE ENTRY INTO FORCE OF THE FOREST LAW OF 2011 AND ANALYSIS OF THE FUNCTIONAL MANAGEMENT OF STATE FOREST ENTERPRISES ESTABLISHED UNDER ART. 163 OF THE FOREST ACT

Abstract

The State Forestry Department has over 140 years of history and has gone through many forms of governance, different institutional structures and undergone numerous reforms. After 2011, with the new Law on Forests, the state forestry department underwent another reform aimed at separating control functions from management and management functions. With the OG, on the one hand, the Executive Agency for Forestry (IAG) was created to carry out the control functions, and on the other hand, 6 state forestry enterprises within the meaning of Art. 62, para. 3 of the Commercial Law (TC) for the implementation of the functions of management and management of the state forest territories.

Over the past five years, there has been a prevailing opinion in the country, and conclusions have emerged in official government documents, that state-owned enterprises are not showing good economic performance due to their weak corporate governance. The purpose of the present work is a brief analysis of the institutional development of the state forestry structures, after the entry into force of the Law on Forests of 2011 and an analysis of the functional management of the state forestry enterprises established under Art. 163 of the Forestry Act.
